Corruption and Activism: Are Constitutional ideas being threatened

Lately we have witnessed a lot of turbulence in Indian politics. Invariably, the turbulences are unusual departure from various prevailing perspectives of the idea of socialism, nationalism and constitutionalism.
No one among us would deny that the country is not only frustrated with the current state of affairs in polity but is also, to a large extent is confused. My major area of concern in present socio-political scenario is the impact of current anti corruption movements in the country, majorly affected by the emergence of the concept of civil society which is yet to gain its organizational structure. With the growing uproar of social networking websites and by the result of technological developments, every other person has become an activist today. Every day the social feeds on facebook, twitter and likes, comes up with a platter of revolutionary write ups concerning different aspects of existing political and social turbulences. In fact what can one think of, where the headline of every day’s news paper begins with the exposure of a corruption by our representatives. Increasing number of corruption has become such that even our brain gives up at a point of time when we dictate it to keep a track of them. But this unorganisational emergence of the society of activists and the easy access to expression of our thoughts on social networking websites is slowly becoming a big threat to the spirit of Indian constitution, as, while expressing ourselves, most of the time we forget the responsibility attached to that and sometime we go beyond the boundaries of constitutional parameters and often ignore values like fundamental duties.
As it has been stated in the beginning, turbulences are unusual departures from various prevailing perspectives. One of the main reasons for which this statement is made is that to my understanding of the history of Indian polity, this is the first time when we have started challenging the very basis of the structural setup of democracy. Nowadays, on social media, though not highlighted much, but we often hear from many of us that the democratic setup of the country has failed completely. I must mention here that the Indian democracy is the largest democracy of the world. The beauty of this democratic setup lies in the spirit of the people. The governmental setup somehow reflects the will of the people of the country. I am not at all supporting the corrupt practices reflected in the actions of the people’s representatives and I also feel disgusted and cheated when the headlines of the news papers start with exponentially increasing scams and corruption. But somewhere down the line, it is evident that the prevailing corrupt practices has not occurred overnight and while introspecting, within the bottom of the democratic setup, I find that the current governmental setup is reflection of the down fall of the social strata. May be it is harsh to accept but now we should not deny this reality that all of us are corrupt at one or the other point of time. If we do not get a confirmed berth in a train, we do not hesitate on offering money to the TTE and always take this plea that we are helpless, we also do not hesitate in offering money to the court staffs to avoid the procedural difficulties and we take this safeguard that since they are corrupt so we are left with no other option. We always look for an easy way to take a course to satisfy our instant need. One thing we need to understand here is that we would always get a political setup which is the epitome of the existing public morality. It is not being stated here that the protests and the feelings attached thereto are bad or innocent or are with any malice. But only point which is being made here is that more than anything else we need an introspection of ourselves followed by much more responsible actions. We often forget that fighting against anything requires a lot of sacrifices attached to it. In order to fight against corruption and in order to dream for a shining future of our great nation, the most important sacrifice according to me is to suffer the consequences of not offering bribes. It may sound stupid to many of us but think about it once.
Indian constitution is a wonderful compilation of beautiful set of ideas. In a country where the diversities vastly vary from language, color, caste and religion, our constitution has managed to balance all the conflicting interests of the country. This is one of the many reasons due to which in spite of numerous diversities existing in Indian society, the constitution has managed to find its humble place for its survival. Once, while having a discussion with one of my learned friend on the existing state of affairs, he made a point that the time is not far when we should start thinking in the lines of burning the constitution. I often see posts on facebook and twitter challenging the idea behind the present democratic setup. When I see such Ideas being expressed vehemently, I do not only feel disgusted but also feel appalled by such reactions which are the outcome of losing faith from the largest democracy of the world. This is why I mentioned above that the country is in a great state of confusion. We are confused as we do not find a proper channel or structure to base our faith on. In such a scenario, it is strongly advocated for limiting our actions within the parameters of the constitutional ideas.

With these varied set of ideas in mind I wish to see a real shining India with increased moral and ethical standards of the society having a better reflection by the governmental organizations.

This post is dedicated to the only regular visitor of my blog.

Its said that, in litigation, we cannot afford to make our personal feelings visible on our faces. Perhaps this is the only profession in this country where a human being is supposed to be something more than a superhero. It is assumed in our profession that we don’t do anything except for law even during our normal course of life, if we are good advocates or are aspiring to become good advocates.

However I do not mean to say that I have lost my interest or enthusiasm towards my profession, but yes, its so early when I am thinking about taking a break from the profession. To this entire world, it would reflect that this is the same stupid thought which any irresponsible human who is lost in love or is lost by love would think at this stage and the same is nothing but the sign of the behaviour of a loser.

By and large, I also thought that the feeling of being lost in something like this is nothing but a kinda filmy move. But the truth remains that no one would be able to understand this feeling until he gets into it. This is a kind of stage where you also know that your acts are being stupid and impractical but you don’t have control on your actions. I know that this entire note would lead to futility as the same is subject to the feeling of a person who is lost by love.

Enough of philosophies have happened. The only point which I wanted to make is, anybody can make this statement that life is all about moving on and they think that they have acted in a very responsible way, but the difficult part is with the person who has been asked to move on.

Frankly speaking, I do not intend to make a sympathetic note or make a sorry statement but I just want to express one normal problem with the human life which is not normal for the person who is facing it.

I do not have any reason to complain. It has happened the way we wanted it to happen. We knew from the very beginning that we are not going to tie the knot. We knew that inter religion relationship does not have any future for the families like ours. We were cool with the thought that the time will take care of everything between us. Now when the time has taken enough care of all these things, I am trying to resist the decision of time.

It has been heard in stories, written in novels, shown in movies that the love and sacrifice are two sides of the same coin. We appreciate plays like Romeo Juliet or Laila Majnu and praise the sacrifice made by them for their love. But do we have any place for the stories where the desperate love for each other has been sacrificed to maintain the smile on the face of a father? Of course not. Instead we have comments to make that they did not have balls to take tough steps.

By this note, I would like to mention here that having balls in such situation is a very easy thing to do in life. It hardly takes time to decide according to our will and take step which is generally taken in movies, novels or stories.

So I adore her for being a fighter and doing what is good for her parents and the future of all other girls of her family, provided if she takes this kinda step then door for good higher education for all other girls of her family would come to an end.

I adore her for being a fighter. I adore her for being a support to everybody around her. I adore her for being great and still being simple. I adore her for living up to the expectation of the people who are responsible for her existence on this planet.

With these lines I rest my expressions here with the expectation that we get “practical” in our actions and “move on” as advised by the surroundings.

Litigation Diaries

Sometime, some decisions are not just decisions...

In my last semester of college life, almost everybody was certain about their professional life and so I was. I must admit that my so called preachers in college has made huge difference in my decision making power. Now I can suitably ignore such preaching and can decide my own course of life in a more straight forward manner. There are various set of people in this world. there is one set of people who is ready with their exactly opposite view whenever you seek for any opinion. One suitable example from my own life may be:

Me: Yar I was thinking for sitting for campus placements. I don't know whether I would be able to handle well with my uncertain career in litigation or not.

Mr. Concerned: I don't see any reason as to why you have been thinking like this when you were very much determined for your career in litigation. provided the kind of skills and innovation of ideas you possess, I personally feel that you should go for litigation.

After few days:

Me: yar finally I have decided not to sit for placements. now I'm sure that I am going for litigation and I know that I will do well.

Mr. Concerned: have you gone mad!!! you don't know about the no. of lawyers get enrolled every year. Perhaps you don't even know about the kind of uncertainty prevailing in the market. Moreover if you go for a job then then you will be sure about a sum of money coming at the end of month.

Needless to say that I kept mum and decided to choose my future without consulting this Mr. concerned again. moreover neither my grades nor my attitude towards the corporate legal world have made me survive in the world of job mongers. so finally I decided not to sit for college placements. Although many had to say that not much difference would have been created even if I was there.

Finally after contemplating a lot about how to begin my litigation career, I landed in this world of art. Probably I was one of the privileged people to start my practice independently from very first day under the guidance of Mr. K.K. Rai, Senior Advocate, Supreme Court of India.

we tend to change

i remember some part of my life.. until recently i had some ideologies which i assumed to be the most effective and fundamental to have in my life... until recently i decided all the possibilities of becoming childish all the while... until recentily i dint have this quest of becoming wild...
i introspected.. i suspected.. i had a fear... i had an intuition... nature was unknown.. but i moved on... i took this challenge of goin ahead, in search of a new light... i din even know that the path m following will lead me to my destination... but i moved on with the change of the attitude which had happened long back...
i dint even know the destination.. i was fighting as if i was fighting 4 my nation... a ray of positive hope energiged all of us... a madness prevailed which was even more reasonable than the prudence...
a time came... wen "i" became "we".. the change had arrived.. the movement survived... eyes were wet but the hearts were clean... v joined r hands to live our dream... i wonder it was me.. i wonder it was not a dream.. i wonder we were moving together tied in the chain of responsiblities... i wonder we dared to move beyond the set traditions... i wonder i went even beyond my own expectations...
i cant disagree to this fact that i tend to change...
time prevails over the set opinion and the ur innersense over the over the general prudence.....

first time

do u remember that when u spoke first word of your life!! i know, you cannot. but it was a momental happiness to your parents. they wanted you to speak more and they did not get annoyed even when you repeated the same word for many times. this momental happiness again came to your parent's life when u stood on your foot for the first time. it sounded like a great achievement of their life. i hope all of you remember the feeling of your first love. specially if it happened during your teen age. how can you forget your first salary.. you planned a lot about different ways of spending it for your peers and to secure your future.
i am just trying you to remember the feeling of first time.. whatever we do for the first time, we keep them with us for our own life... sometimes it gives a bitter experience, but we do remember even them. we try to think about various situations where we could have edited some portions of our life if the experience of first time was not good. but bilieve me, there cannot be any other feeling than the experience of 'first time'. so dare to do everything which has been offered to you within the ambit of possibility. go ahead.. feel it.. live it.. and it will become an unforgettable titilating feeling of your life..
this is only feeling which lives with our entire life.. so try doing innovative things.. take a new step in every walk of your life with a new enthusiasm and i promise you that you will be different from others and you will be having a collection of feelings which will help you to survive happily during the odd days of your life...

silence of mind

silence- an easy but a deceptive word. what seems to be silent is actually more noisy and hauling than what we think of. I see it as a relative term. But the relation is also an erraneous one. vivekanand says, 'silent mind is ready for everything'. I believe it. but how can we achieve this silence before the end of human existence (death). I have a desire to reach this ultimate stage of human satisfaction but i am lagging far from the posiibility. psychologists agree to the fact that human mind can think about one thing at a time but they have also failed to understand the permuted situation. i believe that the happiness lies in satisfaction, and satisfaction is there in silence. sometimes people appreciate my creativity but the same is against the fundamentals of silence. i wish i could solve this complicated, traumatised concept of 'silenece' to achieve the happiness of the mortal life.

disguised life

life being a series of unexpected events has asked to surrender my weapons. But the other part of it has provided a chain of hope which has created the illusion of creativity. the mirage created is so realistic that even i have started anticipating the greener end of the life. this has always been a proximate picture of illusionary faces which has always shown more than one face even in a linear figure.
now coming to the more realistic appraoch, no human being even of scientific brain can expect sinosudal graph of life. the biggest paradox is, the mirage created is sometimes a real image but bieng in an illusionary state of mind one is in strong belief that the the realistic imge is nothing but a mirage.
As Aristotle rightly observes that the ultimate goal of human life is happiness, the same being of subjective nature has created more complex illusion in human life.
